Syndicate Legal Advisory Services prepares the complete set of court documents required to commence and support a civil partition action seeking the division (partition in kind) or sale (partition by sale) of co-owned real property (or, where applicable, personal property) among co-owners who cannot agree on its use, management, or disposition.

Scope of Documents Prepared

  • Complaint or petition for partition (or equivalent initiating pleading), including legal description of the property, identification of all known co-owners and their claimed interests, statement of the estate or interest sought to be partitioned, and (if partition by sale is requested) allegations supporting that remedy
  • Summons and related process documents
  • Notice of lis pendens (notice of pending action) for recording against the property
  • Supporting affidavits, declarations, or verifications regarding ownership, title history, or other facts as required by the jurisdiction
  • Jurisdiction-specific cover sheets, civil case information statements, and other required filing forms
  • Optional related documents such as requests for publication of notice for unknown parties, basic motions, or templates related to appointment of a referee/commissioner or appraisal (where applicable)

Documents are customized to the facts you provide and to the procedural and substantive requirements of the specific state and court in which the action will be filed. This includes tailoring to local partition statutes, common-law principles, and, where the property qualifies as “heirs property,” the Uniform Partition of Heirs Property Act (UPHPA) or equivalent state adoption (which can impose additional appraisal, buyout, and sale procedures).
