Syndicate Legal Advisory Services complete the state’s published small estate affidavit, or the court’s own simplified form where the state uses one and organizes the successor’s documents.

What’s included:

  • Jurisdiction table check. Using our state table, we give the successor the state’s own published rules: the current value limit, what is counted, the waiting period, who may use the affidavit, whether real property is covered, whether a court filing is required, and the required form. We do not decide whether the successor meets them.
  • Decedent and relationship record. The successor supplies a certified death certificate and states the decedent’s name, date and place of death, and domicile. The successor states the successor’s own relationship to the decedent, and whether the decedent left a will.
  • Intake and information gathering. A structured questionnaire records the successor’s own statements: the successor’s name and address, the names of the decedent’s spouse, children, and other persons the form requires, the holders of the property (banks, employers, brokerages, agencies), the account types, and the successor’s own statement of approximate values.
  • Asset list (successor’s figures). We prepare the successor’s own list of each asset and its value as the successor states it, from statements the successor supplies.
  • Affidavit completion. From the successor’s statements, we complete the state’s published affidavit, including the successor’s statement of entitlement, the waiting-period date as the successor states it, the statement that no probate is pending, and the list of property to be collected, exactly as the successor states it.
  • Other successors and notice information. Where the state requires notice to other heirs or a declaration of other heirs’ entitlement, we type the names and addresses the successor supplies. We do not locate heirs or advise on whether notice is required.
  • Signing packet. We prepare the signature page and any notarial acknowledgment the state requires. The successor signs under penalty of perjury, before a notary where required.
  • Presentation checklist. From public guidance, we give the successor a checklist of what holders commonly ask to see (the affidavit, the certified death certificate, identification, and sometimes their own forms).
  • Court form completion (where the state uses a court procedure). Where the state requires a simplified court petition instead of a pure affidavit, we prepare the court’s own form from the successor’s statements, with the added screens in our Probate entries, and the successor files it. We do not draft pleadings under this plan.
  • Document organizer. We organize the successor’s own documents (the death certificate, the will, account statements, deeds, vehicle titles, insurance policies, funeral bills, and any prior court documents) into a labeled file.
  • After-signing checklist. A neutral list, from public guidance, of what may follow: presentation to holders, holder questions, any recording requirement, and the state’s published rules on keeping records and on reporting.
  • Review and revisions. We make revisions you request to the typed forms before signing, within the review rounds in your package, only on the successor’s instruction.
