Syndicate Legal Advisory Services prepares the client’s EEOC’s intake questionnaire and charge of discrimination (EEOC Form 5), and, if the client requests, for a parallel state or local agency charge, and organizes the client’s own documents.

What’s included:

  • Intake and information gathering. A structured questionnaire records the client’s own statements: the client’s name and contact information, the employer’s name, address, and approximate number of employees (if known), the dates of employment, the dates of each event the client wants to report as the client remembers them, the names and job titles of the people involved, and any witnesses.
  • Basis and issue selection (client’s selection). From the EEOC’s own published list, the client selects the characteristics (such as race, sex, age, disability, religion, national origin, pregnancy, genetic information, retaliation) and the types of action (such as firing, discipline, harassment, pay, failure to accommodate) the client believes apply.
  • Client narrative. The client writes, or dictates, a chronological statement of what happened.
  • Intake questionnaire preparation. From the client’s statements, we prepare the answers for the EEOC’s online intake and the charge form, including the “bases,” employer information, and dates as the client states them. The client reviews every answer.
  • Verification and signature by the client. The client, not Syndicate, reads and signs the charge under penalty of perjury, after reading the EEOC’s warnings.
  • Document organization. We organize the client’s own documents (offer letter, pay stubs, performance reviews, disciplinary notices, termination letter, emails and texts the client chooses to include, medical or accommodation requests, and any arbitration agreement or release the client holds) into a labeled chronological file.
  • Fee information. The EEOC charges no filing fee. We direct the client to the EEOC’s own materials.
  • Filing packet. We provide a printable packet with the prepared answers and instructions for the client to submit the charge through the EEOC portal, by mail, or in person, or to ask the EEOC for an interview. We do not hold or use the client’s portal credentials.
  • Optional parallel state charge. If the client requests, we prepare the client’s answers for the state or local agency’s intake form (for example, California’s CRD). State rules, deadlines, and “dual-filing” arrangements vary.
  • After-filing checklist. A neutral list, from the EEOC’s public guidance, of what the client may receive: a charge number, a notice to the employer, a request for a position statement, an offer of mediation, a request for information, a dismissal and right-to-sue notice, or a notice of a determination, along with the EEOC’s published statement that a lawsuit generally must be filed within 90 days of a right-to-sue notice. We do not advise on what these mean or how to respond.
  • Review and revisions. We make revisions you request to the prepared answers before the client submits them, within the review rounds in your package.
