Syndicate Legal Advisory Services prepares the client’s answers for the official USPTO trademark application and organize the client’s own materials.
What’s included:
- Intake and information gathering. A structured questionnaire records the client’s own statements: the mark exactly as the client wants it to appear (standard characters, or a design as the client supplies it), the owner’s legal name, entity type, state or country of organization, and address, the email for USPTO correspondence, and the client’s description of the goods or services.
- Ownership record (client’s statement). The client states who owns and controls the mark, and, for an entity, the entity’s exact legal name and state of formation, supported by any formation document the client supplies.
- Filing basis record (client’s statement). The client states, using the USPTO’s own published descriptions, whether the mark is already in use in commerce, with the date of first use anywhere and first use in commerce as the client states them, or whether the client has a bona fide intent to use it.
- Goods and services record (client’s statement). From the USPTO’s own published ID Manual, the client selects the entries that describe the goods or services, and we type the client’s selections. We do not draft or recommend wording, choose classes, or advise on scope. A client who wants wording not found in the ID Manual is referred out.
- Specimen organizer. For an in-use basis, the client provides a specimen showing the mark in use (for example, a photograph of the actual product, packaging, or a screenshot of the actual website with the URL and date). We organize the client’s own files into the format the USPTO’s instructions describe. We do not create, edit, mock up, or alter any specimen, and we refer any client who has only a draft or mockup.
- Disclaimer and translation fields (client’s statement). If the mark contains non-English wording or a name or likeness of a living person, the client states the translation or provides the person’s consent, and we type what the client supplies. We do not advise whether a disclaimer is needed.
- Application preparation. From the client’s statements, we prepare the answers for the USPTO’s online application (the TEAS form), including the mark, owner information, basis, identification, and correspondence address. The client reviews every answer.
- Declaration and signature by the client. The client, not Syndicate, reads and electronically signs the declaration under penalty of perjury, after reading the USPTO’s warnings.
- Fee information. We direct the client to the USPTO’s published fee schedule (fees are per class and are charged whether or not the mark registers). The client pays the USPTO directly. We do not collect or transmit the government fee.
- Filing packet. We provide a printed or digital packet with the prepared answers, the specimen file, and step-by-step instructions for the client to create or use their own USPTO.gov account (with identity verification, which only the client can complete), enter the answers, pay, and submit. We do not hold or use the client’s credentials.
- After-filing checklist. A neutral list, from the USPTO’s public guidance, of what the client may receive: a filing receipt and serial number, an examining attorney’s office action, a publication for opposition, a notice of allowance (for an intent-to-use application), a statement of use deadline, a registration certificate, and later maintenance filings.
- Review and revisions. We make revisions you request to the prepared answers before the client enters them, within the review rounds in your package.
