Syndicate Legal Advisory Services prepares the court forms and letters a tenant uses to respond to an eviction on the forms required in the state and county where the property is located.
What’s included:
- Urgent triage. At first contact we ask the client for the date and manner they were served and the response deadline stated on the papers, and we put the deadline at the top of the file. If the deadline is within a few days, we tell the client in writing that they should file at the court immediately, contact legal aid or the court self-help center the same day, and that we cannot guarantee we can finish in time.
- Resource list. Before intake, we give every client a written list of free help: legal aid, the court’s self-help center, local right-to-counsel and tenant organizations, eviction diversion and emergency rental assistance programs, and the housing authority if the tenancy is subsidized.
- Intake and information gathering. A structured questionnaire and document checklist collect the tenant’s and household members’ names, the property address, the lease or rental agreement, rent amount, payment records and receipts, the notice received (with date and how it was delivered), the summons and complaint (if served), repair requests and conditions, any complaints made to a landlord or agency, any communication with the landlord, and the outcome the client wants.
- Document review and organizing. We organize the client’s documents into a timeline and exhibit index.
- Response to the eviction complaint. We complete the state’s form answer (for example, the Answer for an unlawful detainer in California), including any defenses the client chooses from the court’s checklist. We provide the court’s neutral checklist of common defenses as information.
- Fee waiver request. If the client cannot afford court fees, we complete the court’s fee waiver request from the information provided, which generally must be filed with the response.
- Other routine forms (optional). From facts the client supplies, we prepare requests such as a request to set a hearing or trial date, a request for a continuance, a request for reasonable accommodation letter addressed to the landlord, and a notice of change of address.
- Pre-suit and non-court letters (optional). Over the tenant’s signature, and from facts the client supplies, we prepare letters such as a written repair request, a request for a copy of the lease or ledger, a dispute of the amount claimed, a notice of intent to pay, and a request to the landlord for more time or a payment plan.
- Rent payment and rental assistance paperwork (optional). We complete the application forms and organize the supporting documents for a government or nonprofit rental assistance or eviction diversion program, from information the client supplies.
- Stipulation and settlement forms (optional). If the tenant and landlord have agreed to terms, we prepare a stipulation for entry of judgment, a payment plan, or a move-out agreement from those terms.
- Service documents. We prepare any proof of service the client needs for papers they file or send. The client cannot serve papers on a landlord if they are a party, so we help arrange service through an adult who is not a party where service is required.
- Filing logistics. We provide a filing packet with copy and filing instructions, and at the client’s direction handle e-filing or courier filing where the court allows. We encourage the client to keep a file-stamped copy and a calendar of every court date.
- Hearing packet. We prepare an exhibit index and a checklist of what to bring. We do not prepare the client to testify or appear.
- Post-judgment forms (limited). From facts the client supplies, we prepare a request to stay or delay enforcement, a motion to set aside a default, or a notice regarding the return of personal property or security deposit, using the court’s form. We refer contested motions to an attorney.
- Security deposit documents (optional). From facts supplied, we prepare a demand letter for the return of the deposit and, where the client chooses small claims, the small claims forms, following our Consumer and Commercial Disputes description.
