Syndicate Legal Advisory Services prepares a deed of trust and related loan documents on the forms required in the state and county where the documents will be filed.
What’s included:
- Intake and information gathering. A structured questionnaire collects the trustor’s (borrower’s) and beneficiary’s (lender’s) names and entity information, marital status, the property address, the assessor’s parcel number, the county, the legal description and current vesting (taken by you from the recorded deed or a title report), the loan amount, interest rate, payment schedule, maturity date, and the trustee you or the lender select.
- Deed of trust preparation. We prepare the deed of trust with the recording information block, the legal description exactly as you supply it, the grant of security interest, the power of sale and standard covenants, the trustee designation, and the terms you select, such as due-on-sale, late charges, and prepayment provisions.
- Promissory note (companion document). From the agreed terms, we prepare a secured promissory note describing principal, interest, payment schedule, default, and acceleration terms. The note and deed of trust must match, and we type them from one set of client-supplied terms.
- Assignment of rents (optional). For income property, we prepare an assignment of rents provision or separate instrument, from the terms you select.
- Request for notice (optional). At the beneficiary’s direction, we prepare a Request for Notice of Default for recording, from information you supply.
- Notary acknowledgment. We prepare the acknowledgment certificate and written signing instructions. A commissioned notary independent of our service must verify the signer’s identity.
- Spousal and co-owner signature blocks. Where you identify a spouse or co-owner, we include the signature blocks you request.
- Recording packet. We provide a recording cover letter, a recorder checklist, and delivery instructions. At your direction, we deliver the signed deed of trust to the county recorder with the fee you provide. We do not hold funds or act as escrow.
- Payment tracking aids (optional). We provide a payment ledger template for the parties’ use. We do not service loans or collect payments.
- Review and revisions. We make revisions you request to the drafts before signing, within the number of review rounds included in your package.
