Syndicate Legal Advisory Services prepares court forms and supporting paperwork connected to an execution sale of real property, on the forms required in the state and county where the documents will be filed.
We do not decide whether to levy on real property, whether a property can lawfully be sold, what to bid, or whether a sale is valid. The sheriff or marshal, not Syndicate Legal Advisory Services, conducts the sale and issues the sheriff’s deed. We are not a levying officer, title company, escrow company, or real estate broker.
What’s included:
- Intake and information gathering. A structured questionnaire and document checklist collect the case name, number, and court, the judgment date and balance, the judgment debtor’s name and the property address, the assessor’s parcel number, the legal description (taken by you from the recorded deed or a title report), any recorded Abstract of Judgment, and the status of any prior collection steps.
- Writ of Execution. We complete the Writ of Execution from the facts and amounts you supply, and the instructions to the levying officer.
- Judgment lien and levy support forms (optional). From information you supply, we prepare an Abstract of Judgment and the cover letter and instructions to the levying officer for a levy on real property.
- Application for order to sell a dwelling (optional, higher-tier). Where the property is a dwelling, we complete the Judicial Council forms and a declaration in your own words for the application for a court order permitting sale.
- Notice and service documents. We prepare the proofs of service for the notices the creditor must give, and a checklist of the notices the sheriff or marshal’s office requires.
- Sale-day checklist (for a purchaser or the creditor). We provide a general checklist of what a bidder commonly brings, such as the officer’s deposit requirements, the form of payment the officer accepts, and identification. Payment goes directly to the levying officer. We do not hold or transmit funds.
- Review of the sheriff’s deed for transcription only (optional). After the levying officer delivers the deed, we compare the names and legal description against the client’s own records and flag typographical mismatches for the client to raise with the officer.
- Recording packet. We provide a recording cover letter, a recorder checklist, and instructions for the deed, the Preliminary Change of Ownership Report from figures you supply, and the documentary transfer tax declaration or exemption you identify. At your direction, we deliver the deed to the county recorder with the fee you provide. We do not hold funds or act as escrow.
- Redemption-period record. We provide a worksheet recording the sale date and the dates the client identifies. It is a record-keeping aid, not a deadline calculation.
- Post-sale forms (optional). From facts you supply, we prepare a Memorandum of Costs, an Acknowledgment of Satisfaction of Judgment, and a release of the Abstract of Judgment where the judgment is satisfied.
- Review and revisions. We make revisions you request to the drafts before signing, within the number of review rounds included in your package.
