Syndicate Legal Advisory Services prepares a deed transferring real property as a gift, on the forms required in the state and county where the documents will be filed.
What’s included:
- Intake and information gathering. A structured questionnaire collects the grantor’s and grantee’s names exactly as they appear on title or as the grantee wishes to take title, their relationship, marital status, the property address, the assessor’s parcel number, the county, the current vesting and legal description (taken by you from the recorded deed or a title report), and the recording return address.
- Gift deed preparation. From the form you select (a grant deed or a quitclaim deed), we prepare the deed with the recording information block, the transfer language, the legal description exactly as you supply it, the vesting you select, and a statement that the transfer is a gift for no consideration.
- Documentary transfer tax statement. From the facts you identify, we note on the deed the claimed exemption for a transfer without consideration.
- Preliminary Change of Ownership Report (PCOR). We complete the PCOR from information you supply, including any exclusion you identify (for example, a claimed parent-child exclusion).
- Grantor acknowledgment and attestation. We prepare a written client acknowledgment, to be signed by the grantor before we prepare the deed, confirming that the grantor decided to make the gift voluntarily, understands the transfer is generally permanent, was advised to consult an attorney and a tax adviser, and is acting without pressure from the grantee or anyone else.
- Notary acknowledgment. We prepare the acknowledgment certificate and written signing instructions. A commissioned notary independent of our service must verify the grantor’s identity.
- Spousal and co-owner signature blocks. Where you identify a spouse or co-owner, we include the signature blocks you request. We do not determine who must sign.
- Recording packet. We provide a recording cover letter, a recorder checklist, and delivery instructions. At your direction, we deliver the signed deed to the county recorder with the fee you provide. We do not hold funds or act as escrow.
- Gift tax information sheet. We provide a general notice that gifts above the federal annual exclusion may require a gift tax return, and that the grantor should consult a tax professional. We do not prepare Form 709 or advise on gift tax.
- Review and revisions. We make revisions you request to the draft before signing, within the number of review rounds included in your package.
