Syndicate Legal Advisory Services prepares the court forms and supporting documents to request a judgment debtor examination, on the forms required in the state and county where the case is or will be filed.

What’s included:

  • Intake and information gathering. A structured questionnaire collects the case name and number, the court, the judgment date and amount, the parties’ names and last known addresses, any prior collection efforts, and any payments received. You supply a copy of the judgment.
  • Application and Order for Appearance and Examination. We prepare the Application and Order for Appearance and Examination for the judgment debtor, or for a third person who owes the debtor money or has the debtor’s property, based on the choices you make.
  • Supporting declaration. Where the court requires it, such as for an examination of a third party or an examination within the limited period after a prior one, we prepare a declaration containing the facts you state, in your own words.
  • Subpoena duces tecum (optional). At your direction, we prepare a subpoena or document request for records to be brought to the examination, listing the categories of documents you select.
  • Questionnaire form. We provide the standard debtor examination question outline, with no case-specific strategy, for you to use or not use at the examination.
  • Service documents. We prepare the proof of service forms and a service checklist, including the notice that service must occur within the time the law requires before the hearing. At your direction, we arrange personal service through a registered process server at your cost. We do not serve papers ourselves unless authorized and qualified to do so.
  • Filing logistics. We provide a filing packet with signature, copy, and filing instructions. At your direction, we can handle e-filing, courier filing, and hearing-date scheduling steps where the court allows.
  • Hearing packet. We prepare a packet and checklist of items to bring, including the original order, proof of service, and the judgment.
  • Non-appearance documents (optional). If the debtor fails to appear, we prepare, at your direction, the declaration of non-appearance and the application for a bench warrant or contempt order, as a separately priced module.
  • Follow-up forms checklist. We provide a general list of collection forms available after the examination, such as a Writ of Execution, Earnings Withholding Order, Abstract of Judgment, and Memorandum of Costs. Preparing them is a separate service.
