Syndicate Legal Advisory Services completes the court’s published probate forms and organizes the personal representative’s documents.
What’s included:
- Jurisdiction table check. We give the client the state’s published rules on venue, formal versus informal procedure, bond, notice, creditor periods, and required forms.
- Decedent, will, and heirs record. The client supplies the certified death certificate and the original will (to be lodged with the court as the state requires) and states the names and addresses of the surviving spouse, children, heirs, beneficiaries, and any nominated executor as shown in the documents.
- Petition for probate and appointment. From the client’s statements and documents, we complete the court’s petition (for example, DE-111) and related forms, including the estimated value as the client states it, exactly as stated, without legal conclusions.
- Notice of hearing and service forms. We prepare the notice of hearing, the notice of petition, and the proof of service forms, with a neutral checklist from the court’s published rules of who must be notified. The client or an adult non-party completes service. We do not serve or publish.
- Bond information. We provide the court’s published information on when a bond is required and how to obtain one from a surety. The client obtains and pays for any bond.
- Order and letters forms. We prepare the proposed order for probate and the letters, and the representative’s acknowledgment of duties, from the client’s statements. The representative reads and signs.
- Creditor notice and claims log. We prepare the notice to creditors where the state requires one, from names the client supplies, and keep a log of claims the client reports receiving, recorded exactly as received.
- Inventory and appraisal schedules. We prepare the client’s own list of assets and values as stated, and the schedules and referee or appraiser’s values exactly as the referee or appraiser supplies them.
- Records and ledger of receipts and disbursements. From the representative’s bank statements and receipts, we enter transactions by date, payee, amount, and the client’s description, in the court’s published categories, and flag unclear items to the client’s lawyer.
- Interim and final accounting schedules (see our Probate Accounting entry). We prepare the accounting schedules and forms using the added screens in that entry.
- Petition for final distribution and closing forms. From a plan of distribution the client states is dictated by the will, or the court’s order, we prepare the petition, the proposed order, and the receipts and releases from beneficiaries.
- Compensation information (no calculation). We give the client the state’s published description of how fees are set.
- Tax information sheet. A neutral sheet from taxing authorities’ own publications on the final return and the fiduciary return, with no application to the client’s facts, and no tax return preparation under this service.
- Document organization. We organize the will, letters, inventory, statements, receipts, tax records, correspondence with heirs and creditors, and court orders into a labeled file, without interpreting them.
- Filing packet. A printable packet with prepared forms, copy and signature instructions, and the court’s filing procedures. The client signs under penalty of perjury and files. We do not file unless counsel confirms it is permitted.
- After-filing checklists. A neutral list, from the court’s public guidance, of the steps that follow each filing (hearing, letters, creditor period, inventory, accounting, distribution, closing).
- Fee waiver forms (optional). We type the client’s answers on the court’s fee waiver forms without advising on eligibility.
- Review and revisions. We make revisions you request to typed documents before signing, within your review rounds, only on the client’s instruction and only to match the client’s documents.
