Syndicate Legal Advisory Services prepares a written postnuptial agreement between spouses.
What’s included:
- Jurisdiction table check. Using our state table, we give the client the state’s own published information on postnup requirements (writing, disclosure, counsel, waiting periods, notarization or witnesses, and recording where real property is affected).
- Intake and information gathering. A structured questionnaire records the client’s own statements: both spouses’ names and addresses, the date of marriage, the states where each lives, children from this or prior relationships, and the reason the spouses want an agreement as the client states it.
- Agreed-terms worksheet (both spouses). The spouses each complete and sign a worksheet stating, in their own words, the terms they have agreed on: which assets and debts are treated as separate or shared, how income and appreciation are treated, and any other term they choose.
- Disclosure schedules (each spouse’s figures). We prepare each spouse’s own lists of assets, debts, income, and accounts, from that spouse’s documents, with no valuation, characterization, or advice. Each spouse reviews and signs their own schedule, and each is warned in writing that an incomplete schedule can void the agreement.
- Agreement preparation. From the signed worksheet and schedules, we prepare the agreement using the state’s required format and a standard structure, with the spouses’ terms stated as the spouses wrote them.
- Review period record. We record the date each spouse received the draft and the date each signed, so the spouses can see how much time passed.
- Signing packet. We prepare signature pages and any notarial acknowledgment or witness blocks the state requires. Each spouse signs personally. We do not sign, witness, or notarize.
- Real property and account follow-up information. Where the agreement changes how real property or accounts are held, we give a neutral notice that separate deeds or retitling may be needed and refer to the Quitclaim Deed and Grant Deed entries. We do not prepare them under this service.
- Document organization. We organize each spouse’s own documents (marriage certificate, deeds, account statements, tax returns, loan documents, business records, and any existing agreements) into a labeled file.
- Review and revisions. We make revisions you request to the typed documents before signing, within the review rounds in your package, only where both spouses confirm the change in writing.
