Syndicate Legal Advisory Services prepares the client’s notice of pendency of action (lis pendens) for a case the client has already filed in court and assembles a recording packet.
What’s included:
- Pending-case requirement check. At intake, the client provides the file-stamped complaint or petition, the case number, and the court. If no case has been filed, the service stops.
- Jurisdiction table check. Using our state table, we give the client the state’s own published requirements for a lis pendens: who may record, whether a court order is required, required contents, signature rules, service and proof requirements, and any expungement or release procedures.
- Intake and information gathering. A structured questionnaire records the client’s own statements: the case name, number, court, and filing date, the parties’ names as stated in the pleading, the client’s role, the property’s street address, parcel number, and county, and the owners of record as the client states them.
- Legal description organizer. We copy the legal description verbatim from a recorded deed, title report, or tax record that the client supplies, and we match it to the address and parcel number.
- Lis pendens preparation. We prepare the state’s notice form, or a notice that follows the state’s statutory content requirements, including the court, the case number, the parties, a statement that the action affects title to or possession of the described real property (as stated in the pleading), and the legal description.
- Signature block. The notice is prepared for signature by the client personally. We do not sign for anyone and do not act as the signing agent. Where a notarial acknowledgment is required for recording, the client completes it before a notary.
- Service and mailing packet. We prepare the proof of service form and a checklist from the state’s published rules for notifying owners and adverse parties, with the addresses the client supplies. The client or an adult non-party completes the mailing or service and signs the proof of service.
- Recording packet. We provide a printable packet with the notice, a copy-and-certification checklist, the county recorder’s published cover sheet and fee information, and any transfer tax or preliminary change of ownership exemption statement the recorder requires. The client records the notice, personally or by a recording service the client chooses. We do not record and do not hold funds for recording.
- Filing of proof in the case file (optional). If the state requires filing proof of recording or service in the court file, we prepare the court’s own form from the client’s statements. The client signs and files.
- Document organizer. We organize the client’s own documents (the pleading, the deed, the title report, the recorded notice, mailing receipts, and correspondence) into a labeled file. We do not interpret them.
- After-recording checklist. A neutral list, from public guidance, of what may follow: an expungement motion, a hearing notice, a demand to release, or a title company inquiry, and of the state’s rules on releasing a notice when a case ends.
- Review and revisions. We make revisions you request to the typed notice before signing, within the review rounds in your package.
