Syndicate Legal Advisory Services prepares letters, forms, and organized records for a person who believes they are a victim of identity theft.
What’s included:
- Intake and information gathering. A structured questionnaire and document checklist collect the client’s information, when and how the client learned of the problem, each account, charge, or filing the client believes is fraudulent (with dates, amounts, and institutions), the client’s free credit reports, collection letters, bills, tax notices, and any police or FTC reports. The client states, item by item, that each listed item is not theirs.
- FTC Identity Theft Report support. We help the client complete the FTC’s online report and affidavit from the client’s own account, and organize the printed report and recovery plan.
- Police report materials. We prepare a one-page summary and document packet for the client to take to the local police when filing a report, from facts supplied. We do not file the report or contact police.
- Fraud alert and credit freeze letters. Over the client’s signature, we prepare fraud alert (initial, extended, and active duty) and security freeze or thaw request letters to Equifax, Experian, and TransUnion, and, if the client chooses, to the specialty reporting agencies, with a mailing checklist.
- Credit report dispute and block letters. For each item the client states is fraudulent, we prepare a dispute and request-to-block letter to the credit bureaus (FCRA §605B) with the identity theft report attached, and a letter to the furnisher or creditor, from the client’s facts.
- Creditor and bank fraud notices. We prepare letters to banks, card issuers, and lenders reporting unauthorized transactions or accounts, requesting closure, a fraud affidavit, account records, and written confirmation that the debt is not the client’s.
- Debt collector letters. Where a collector contacts the client, we prepare a written dispute and validation request and a notice that the debt results from identity theft, with a request to cease collection and to provide the related business records.
- Business records requests. We prepare the request for application and transaction records related to a fraudulent account, which creditors must provide to victims, and a law-enforcement-authorization form.
- Tax identity theft forms (optional). We complete the Identity Theft Affidavit (IRS Form 14039) and prepare a cover letter for the IRS and state tax agency. We do not prepare tax returns or advise on tax liability.
- Government benefits and records (optional). We prepare letters to the Social Security Administration (requesting an earnings statement review), the Department of Motor Vehicles, the U.S. Postal Inspection Service, and a state unemployment agency for fraudulent claims, from facts supplied.
- Medical identity theft and other records (optional). We prepare requests to a provider or insurer for the client’s records and an amendment request for incorrect entries.
- Court order forms (optional, additional fee required). In states that offer it, we complete the state’s form petition for a court finding of factual innocence or identity theft expungement, from the client’s own statements.
- Employer, background check, and landlord letters (optional). We prepare letters explaining a fraud-related record and requesting correction.
- Complaint forms. From facts supplied, we complete complaints to the CFPB, the state attorney general, the state financial regulator, or a creditor’s complaint office.
- Case log and evidence binder. We provide a log of every contact (date, institution, person, and outcome) and a document index, from information the client supplies.
- Review and revisions. We make revisions you request to the drafts before sending, within the number of review rounds included in your package.
