Syndicate Legal Advisory Services prepares court forms and supporting documents for a person seeking to be appointed guardian (or to respond to or end a guardianship), at your direction and using the facts and choices you provide, on the forms required in the state and county where the case is filed.
What’s included:
- Intake and information gathering. A structured questionnaire and document checklist collect the petitioner’s information, the proposed ward’s name, age, residence, and living situation, the parents’ (or the adult’s relatives’) names, addresses, and status, any existing custody, dependency, divorce, guardianship, or adoption case, any restraining orders, the child’s five-year residence history, the proposed guardian’s household members, and the reason the client seeks the appointment.
- Petition for appointment. We complete the state’s form petition (for example, GC-210 in California) from the client’s own answers and the court’s checklist, with the cover sheet and local forms.
- Consents and background forms. We complete the proposed guardian’s consent, any nomination form, the confidential guardian screening form, and the household background information forms, and prepare a checklist for fingerprinting and background checks, which the client completes.
- Parental consent or nomination forms. Where a parent agrees, we prepare the parent’s consent, waiver of notice, or nomination form from the terms supplied, for the parent to review and sign.
- Notice and service documents. We prepare the notice of hearing, the notice to relatives and parents, and the proofs of service, from names and addresses supplied. The petitioner cannot serve the papers, so service is arranged through an adult who is not a party, or a registered process server at the client’s cost.
- Temporary or emergency guardianship (optional, additional fee required). Where the client selects it, we complete the temporary guardianship petition and the declaration of urgency, and the ex parte notice forms.
- Declaration in the client’s words. We type the petitioner’s own account of the child’s or adult’s circumstances, in specific facts.
- Records review and organization. We organize the client’s records, such as school and medical documents the client lawfully holds, correspondence, and a timeline of care, into an exhibit index.
- Investigation and hearing materials. We provide a checklist for the court investigator or social worker home visit and interview, and a hearing packet with an exhibit index and a checklist of what to bring.
- Order and letters. From the order the court actually makes, we prepare the proposed order appointing guardian, the letters of guardianship, and the acknowledgment of the guardian’s duties, as the court directs.
- Fee waiver request. If the client cannot afford the filing fee, we complete the court’s fee waiver request from the information provided.
- Filing logistics. We provide a filing packet with copy and filing instructions, and at the client’s direction handle e-filing or courier filing where the court allows.
- Post-appointment forms (optional, additional fee required). From the guardian’s records, we complete the state’s periodic report or status form, and, for an adult or estate guardian, the inventory form and accounting forms where the state provides them. We provide a general calendar of the filing dates, which is a record-keeping aid, not a deadline calculation.
- Records and benefits requests. We prepare letters over the guardian’s signature, with the letters of guardianship attached, requesting school enrollment, medical records, and benefits applications, from facts supplied.
- Termination or modification (optional). At the client’s direction, we complete the state’s form petition to terminate, modify, or resign a guardianship, and the order forms, from the client’s own statements.
- Response to a petition (limited). We do not prepare a response for a parent, relative, or ward opposing a guardianship on a matter where we serve the petitioner (see Drafting Notes). Where we serve the responding party in a separate matter, we complete the state’s form response or objection from their own account, and refer contested cases to an attorney.
- Review and revisions. We make revisions you request to the drafts before signing or filing, within the number of review rounds included in your package.
