Syndicate Legal Advisory Services prepares the court forms, letters, and supporting documents a person uses to ask a court or agency to clear, seal, set aside, or limit access to a criminal record on the forms required in the state and county where the case was filed.
What’s included:
- Intake and information gathering. A structured questionnaire and document checklist collect the client’s legal name and any other names used, date of birth, the case number, court, county, and state for each matter, the charges, the dates of arrest, conviction, and sentencing, the disposition, whether the sentence, probation, fines, restitution, and conditions are complete, any other arrests, pending cases, or convictions in any state, and the reason the client seeks relief (employment, housing, licensing, or other).
- Record gathering. We prepare requests for the client’s own records, such as a copy of the court file, the disposition, proof of completion of probation or sentence, proof of payment of fines, and the client’s criminal history record from the state’s repository or the FBI, for the client to sign and send. We do not search for records ourselves.
- Relief-type information sheet. We provide a neutral chart of the types of relief the client’s state offers (for example, dismissal or set-aside, sealing, reduction of a felony to a misdemeanor, certificate of rehabilitation, or pardon), drawn from official public sources, with the form series for each.
- Petition or motion forms. We complete the state’s form petition or motion for the relief the client selects (for example, the Petition for Dismissal in California), from the client’s own answers and the court’s checklist, together with the proposed order, the cover sheet, and any local forms.
- Declaration in the client’s words (optional). Where the court asks for a statement about rehabilitation, employment, family, and/or community involvement.
- Supporting document organizer. We organize the client’s proof of completion, letters of reference, employment records, and certificates into an exhibit index.
- Fee waiver request. If the client cannot afford the filing fee, we complete the court’s fee waiver request from the information provided. Many states reduce or waive fees for record clearing.
- Notice and service documents. Where the state requires notice to the prosecutor, the arresting agency, or the victim, we prepare the notice and proof of service, from names and addresses the client or the court supplies.
- Filing logistics. We provide a filing packet with copy and filing instructions, and at the client’s direction handle e-filing or courier filing where the court allows. We recommend the client keep a file-stamped copy and a calendar of every court date.
- Hearing packet. Where a hearing is set, we prepare an exhibit index and a checklist of what to bring. We do not prepare the client to testify or appear.
- Post-order documents. After an order is granted, we prepare a checklist and form letters for the client to send certified copies to the state repository, the FBI, and, if the client chooses, to background check companies and online databases, asking them to update their records. We do not contact them for the client.
- Review and revisions. We make revisions you request to the drafts before filing, within the number of review rounds included in your package.
