Syndicate Legal Advisory Services prepares the court forms and supporting documents to request, or to respond to a request for, a restraining order.

What’s included:

  • Safety first. Before intake, we give every client a written list of emergency and confidential resources: 911, the National Domestic Violence Hotline, local shelters and advocates, the court’s self-help center, and legal aid. We tell clients that free help is available, that filing is generally free, and that they should contact an advocate if they are in danger.
  • Confidential intake. A structured questionnaire collects the parties’ information and relationship, the children (if any) and their residence history, the incidents the client chooses to describe (with dates, places, and any injuries, weapons, threats, or police reports), and the protection the client asks for.
  • Order type information sheet. We provide a neutral chart of the main order types (domestic violence, elder or dependent adult abuse, civil harassment, workplace violence, and school violence), listing who may use each and the form series. The client selects the type.
  • Domestic violence restraining order forms. We complete the Request for Domestic Violence Restraining Order, and, as applicable, the Notice of Court Hearing, Temporary Restraining Order, Child Custody and Visitation Order, Child Support forms, and the Confidential CLETS Information form, from the client’s selections. These forms vary from state-to-state, but Syndicate Legal Advisory Services ensures that all state forms (and local forms if applicable) are completed.
  • Elder or dependent adult abuse forms. We complete the Request for Elder or Dependent Adult Abuse Restraining Orders and the related hearing and order forms from the client’s selections.
  • Civil harassment and related forms. For stalking, threats, or harassment by someone outside the DVPA relationships, we complete the Request for Civil Harassment Restraining Orders and related forms. Workplace and school violence orders are limited to the forms the client selects and are higher-tier or excluded.
  • Declarations in the client’s words. We type the supporting declaration from the client’s own account, covering conduct such as physical violence, threats and intimidation, stalking, harassment, sexual abuse, and coercive control, isolation, or financial control. We do not add, shape, or exaggerate facts, and we do not suggest that conduct occurred.
  • Temporary order request (ex parte). We prepare the request for a temporary restraining order and the declaration required for it, including the notice information the court asks about, from the client’s facts.
  • Responding to a request. If the client was served with a restraining order request, we prepare the Response from the client’s own account, and a checklist of the hearing and the exhibit rules.
  • Service documents. We prepare the Proof of Personal Service and a service checklist. The protected person cannot serve the papers. Service must be by an adult who is not a party, and at the client’s direction we can arrange a registered process server or sheriff service at the client’s cost or at no cost where the court allows.
  • Firearm relinquishment forms. We complete the forms the court provides regarding firearms and ammunition, from the facts supplied.
  • Fee waiver forms. Because filing a request is generally free, we prepare a fee waiver request only where a fee applies, such as a response in certain cases.
  • Filing logistics. We provide a filing packet with copy and filing instructions and a hearing checklist. At the client’s direction, we can handle e-filing or courier filing where the court allows. We recommend the client keep a copy of the order with them at all times.
  • Hearing packet. We prepare an exhibit index (messages, photos, medical or police records) and a checklist of what to bring. We do not prepare the client to testify or attend.
  • Renewal and modification (optional). We prepare the request to renew or change an existing order, from facts the client supplies.
