Syndicate Legal Advisory Services prepares the paperwork used to request and record the release of a paid-off deed of trust, on the forms required in the state and county where the documents will be filed.
What’s included:
- Intake and information gathering. A structured questionnaire and document checklist collect the property owner’s name, the property address, the assessor’s parcel number, the county, the recording information of the deed of trust (recording date, instrument or document number), the original lender and current servicer or beneficiary, the trustee of record, the loan number, and your proof of payoff, such as a payoff statement, final payment record, or lender letter.
- Payoff confirmation worksheet. We provide a worksheet in which you record the payoff date, the amount paid, and the source of the confirmation.
- Request for Full Reconveyance. From the information you supply, we prepare the form the beneficiary signs and sends to the trustee, with the original note and deed of trust returned as the law requires, for the beneficiary’s signature.
- Cover letters. Over your signature, we prepare letters to the lender or servicer asking it to submit the request to the trustee, asking for the status of the reconveyance, or asking for a copy of the payoff statement or note.
- Deed of Reconveyance (trustee form). Where the trustee or its agent asks the owner or lender to supply the form, we prepare the Deed of Reconveyance from the recording information and legal description supplied from the recorded deed of trust. The trustee must review, sign, and have its signature acknowledged.
- Substitution of Trustee (optional - additional fee). Where the original trustee no longer exists or cannot be reached, and the beneficiary directs it, we prepare the Substitution of Trustee for the beneficiary to sign and record, from information the beneficiary supplies.
- Statutory demand letter (optional - additional fee). If the 21-day period has run without reconveyance, we prepare, over your signature, a written demand to the lender or trustee based on the dates you supply.
- Recording packet. We provide a recording cover letter, a recorder checklist, and delivery instructions. At the trustee’s or beneficiary’s direction, we deliver the signed instrument to the county recorder with the fee you provide. We do not hold funds or act as escrow.
- Post-recording follow-up. We provide a checklist for obtaining a certified copy of the recorded reconveyance, confirming it appears in the county records, and updating insurance, title, and loan records.
- Review and revisions. We make revisions you request to the drafts before signing, within the number of review rounds included in your package.
