Syndicate Legal Advisory Services prepares the court forms and written agreements used to divide debts when a marriage or partnership ends, on the forms required in the state and county where the case is or will be filed.
What’s included:
- Intake and information gathering. A structured questionnaire and document checklist collect the date of marriage or partnership and date of separation, and, for each debt, the creditor, account type, balance, whose name is on it, when it was incurred, what it was used for, and the allocation you and the other party have agreed on or that you request.
- Debt schedule. We prepare the Schedule of Assets and Debts and the debt portion of the Declaration of Disclosure from the figures and records you provide.
- Marital Settlement Agreement debt provisions. From the terms you supply, we prepare the section allocating each debt, including who pays which account, payment deadlines, and each party’s promise to pay their assigned debts.
- Hold-harmless and indemnity language (as selected). At your direction, we include a provision that the party assigned a debt will indemnify the other if the creditor pursues them.
- Equalization and payoff terms (as selected). Where the parties agree to a payment from one to the other to balance the division, or to pay off a joint debt from a sale or refinance, we type those terms and dates as supplied.
- Judgment documents. We prepare the Judgment and the debt allocation attachment, based on your agreement, or the proposed judgment as the court directs.
- Request for Order (optional). Where the parties disagree on debts, we prepare a Request for Order on debt issues, a supporting declaration in your own words, and related attachments.
- Creditor notification letters (optional). At your direction and over your signature, we prepare letters notifying a creditor of a change in account responsibility or requesting a copy of statements. Whether a creditor will change an account is up to the creditor.
- Debt-related transfer documents (optional). From terms you supply, we prepare documents such as a vehicle or property transfer tied to a loan assumption or refinance, and a request for release of liability form where the lender provides one. We do not negotiate with lenders.
- Notice and service documents. We prepare proof of service forms and a service checklist. At your direction, we arrange service through a registered process server at your cost.
- Filing logistics. We provide a filing packet with signature, notarization, copy, and filing instructions. At your direction, we handle e-filing, courier filing, and proof of service preparation.
- Post-judgment checklist. We provide a general list of steps clients often take after judgment, such as closing joint accounts, removing an authorized user, monitoring credit reports, and keeping payment records. It is not advice.
Note for unmarried (non-registered) partners. Unmarried couples do not use the family court’s debt division. Available documents are a written debt separation agreement and payment schedule prepared from terms you provide. Claims against a former partner for debts in a lawsuit are outside this package.
