Syndicate Legal Advisory Services prepares the complete set of documents required for a judgment creditor to create a judgment lien on a judgment debtor’s personal property by filing a Notice of Judgment Lien with the Secretary of State — in California, Form JL-1 under Code of Civil Procedure sections 697.510 through 697.670, and in other states that provide a comparable central filing, such as the Florida judgment lien certificate, the equivalent form — together with the companion abstract of judgment that creates a lien on the debtor’s real property through the county recorder, and the post-filing documents that maintain, amend, and release the liens. A judgment lien on personal property attaches to the debtor’s accounts receivable, chattel paper, equipment, farm products, inventory, and negotiable documents of title, and gives the judgment creditor a priority position against those assets and against later secured parties and buyers that an unsecured money judgment alone does not provide. Working from the client’s answers to a structured intake and from the judgment and the court file, we draft, assemble, and organize the judgment verification, the debtor-name and lien search, the Notice of Judgment Lien, the abstract of judgment and recording package, the notices and follow-on filings, and the renewal and release calendar, so the liens are created correctly, indexed under the right name, and maintained for as long as the judgment remains enforceable. Secretary of State and county recorder fees, court clerk fees for certified copies and abstracts, search fees, and other third-party charges are not included in the flat fee and are the sole responsibility of the client.

Scope of work includes:

  • Judgment verification and intake — a structured intake and written summary confirming the judgment creditor and the judgment debtor exactly as named in the judgment, the court, case number, and date of entry, the amount of the judgment with accrued interest and costs, that the judgment is a money judgment that has been entered and is not stayed on appeal or otherwise unenforceable, whether it is a California judgment or a sister-state or federal judgment that must first be entered or registered in California (or the forum state), whether the creditor has an assignee of record, and the judgment debtor’s entity type and state of organization or, for an individual, residence, which determine where the notice is filed and how the debtor must be named.

  • Debtor-name verification and lien search — retrieval of the debtor’s public organic record to confirm the legal name under which the notice will be indexed, the search of the Secretary of State’s UCC and judgment-lien records and the county recorder’s abstract-of-judgment and tax-lien indices against the debtor’s name and variants, and a written summary of the existing security interests, judgment liens, and tax liens that will have priority and of the debtor’s assets to which the lien will attach.

  • Notice of Judgment Lien — preparation of Form JL-1 (or the state’s equivalent) with the information the statute requires: the names and mailing addresses of the judgment creditor and the judgment debtor, the title of the court and the cause and number of the action, the date of entry of the judgment and of any renewals, the amount required to satisfy the judgment at the date of the notice, and the statement that the judgment is not stayed, with the required signature and declarations, ready for filing with the Secretary of State or submitted on the client’s behalf with the client paying the filing fee directly, and the review of the filing acknowledgment for the file number, filing date, and indexing accuracy, since the lien’s priority dates from filing.

  • Abstract of judgment and real-property lien — the application to the court clerk for the abstract of judgment, the review of the issued abstract for accuracy, and the recording package for the county recorder in each county where the debtor owns or may acquire real property, with the recording cover sheet, the recorder’s fee calculation, and the confirmation of recording, so that the personal-property lien and the real-property lien are created together.

  • Notices to the debtor and third parties — the notice to the judgment debtor where the statute or local practice calls for one, and the notices to account debtors, bailees, or others in possession of the debtor’s personal property where the creditor elects to give them to cut off defenses or protect the lien against transfer, with the demand for turnover or accounting where appropriate.

  • Enforcement coordination documents — the documents that connect the lien to enforcement: the application for a writ of execution, the instructions to the levying officer for a levy on the liened property, the application for an examination of the judgment debtor or a third person, the notice of lien in a pending action or proceeding in which the debtor is a party, and the creditor’s claim in a bulk sale, assignment for the benefit of creditors, or bankruptcy where the lien’s priority must be asserted, each prepared for use by the creditor or its counsel in the enforcement proceeding.

  • Amendment, continuation, and renewal documents — the amendment to the notice of judgment lien where the creditor’s or debtor’s name or address changes, the judgment is assigned, or the amount is corrected; the renewal of the judgment under the state’s judgment-renewal procedure before it expires (ten years in California), with the application, the renewal notice, and the service on the debtor; and the new notice of judgment lien to be filed when the lien’s own term expires (five years in California) while the judgment remains enforceable, with the calendar for each deadline.

  • Satisfaction and release documents — the acknowledgment of satisfaction of judgment for filing with the court and the release of the judgment lien with the Secretary of State and the county recorder when the judgment is paid, in the form and within the time the statute requires after demand, and the partial release where the creditor agrees to release specific property or a specific amount.

  • Post-filing compliance toolkit — a calendar and template set for the judgment-renewal deadline, the judgment-lien expiration and re-filing date, the periodic lien searches to detect intervening filings and transfers, the interest accrual and payoff calculation, the amendment triggers, and the satisfaction and release procedure, with a one-page summary of what the lien reaches, what it does not reach, and the steps the creditor must take to convert it to payment.

Deliverable: a complete, indexed judgment-lien file (electronic and hard copy) containing the judgment verification, the name and lien-search results and summary, the filed or file-ready Notice of Judgment Lien and the filing acknowledgment, the abstract of judgment and recording confirmations, the notices and enforcement-coordination documents, the amendment, renewal, and release forms, and the renewal and expiration calendar, with a filing checklist and signature-ready versions of each document for execution by the judgment creditor or its authorized representative.
