Syndicate Legal Advisory Services prepares the court forms and written agreements used to divide property and debts when a marriage or registered domestic partnership ends, on the forms required in the state and county where the case is or will be filed.
What’s included:
- Intake and information gathering. A structured questionnaire collects the date of marriage or partnership and date of separation, a list of assets and debts (real estate, bank and investment accounts, vehicles, retirement accounts, business interests, personal property, and loans), and the division you and the other party have agreed on, or the division you ask the court to order.
- Disclosure documents. We prepare the Declaration of Disclosure, the Schedule of Assets and Debts, the Income and Expense Declaration, and the Declaration Regarding Service of the disclosure, along with a checklist of the supporting records (statements, deeds, tax returns) you attach.
- Marital Settlement Agreement (MSA). From the terms you supply, we prepare a written agreement allocating each asset and debt, including property equalization payments, transfer deadlines, and each party’s release of claims.
- Property transfer documents. We prepare the documents that carry out the division, such as an interspousal transfer deed or quitclaim deed, vehicle transfer paperwork, and assignment forms. We prepare the forms, and you are responsible for recording, tax filings, and lender notification.
- Retirement account paperwork. We prepare a draft Qualified Domestic Relations Order (QDRO) or a similar order for a plan you identify, using plan information you provide, for submission to the plan administrator for pre-approval. Plan-specific rules vary widely and cause frequent rejections, so see the limits below.
- Judgment documents. We prepare the Judgment, the property attachment, Notice of Entry of Judgment, and any stipulated judgment, based on your agreement, or the proposed judgment as the court directs.
- Request for Order (optional). Where the parties disagree, we prepare a Request for Order on property issues, a supporting declaration in your own words, and the related attachments.
- Notice and service documents. We prepare proof of service forms and a service checklist. At your direction, we can arrange service through a registered process server at your cost.
- Filing logistics. We provide a filing packet with signature, notarization, copy, and filing instructions. At your direction, we can handle e-filing, courier filing, and proof of service preparation.
- Post-judgment documents. We prepare a request for certified copies, a checklist for updating titles, accounts, insurance, and beneficiary designations, and, as a separately priced add-on, a motion to enforce or modify property orders.
Track for unmarried (non-registered) partners (separate scope). Because unmarried couples do not use the family court’s property division, the available documents are written agreements, such as a property or debt separation agreement and bill of sale or transfer documents, prepared from terms you provide. Filing a civil lawsuit for a claim against a former partner is outside this package.
